These Terms of Service (“Terms”) govern your access to and use of Comm-Piler™ and related services (the “Service”) operated by Simon J Williams (“we,” “us,” or “our”) in the United States. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service includes the Comm-Piler web application and related features we make available to your account. We may offer additional official clients (for example, a future mobile companion app) that access the Service using the same credentials; those clients remain part of the Service unless separate platform terms apply (such as app store rules).
You are responsible for maintaining the confidentiality of your credentials and for activity under your account. You must provide accurate information and comply with applicable laws. We may suspend or terminate access for violations of these Terms or to protect the Service or other users.
The Service, including software, text, graphics, logos, and the “look and feel,” is owned by Simon J Williams or its licensors. Comm-Piler™ is a trademark of Simon J Williams. Nothing in these Terms grants you ownership of our intellectual property.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal communications planning and related purposes. You receive no rights to the underlying source code or to redistribute the Service.
You agree not to: (a) copy, modify, create derivative works from, or reverse engineer the Service except where mandatory law permits; (b) probe, scan, or test the vulnerability of the Service without authorization; (c) use bots, scrapers, or other automated means to access or extract data from the Service at a rate or volume beyond normal human use, or in a way that burdens our systems; (d) use content or data obtained through the Service to train, fine-tune, or develop machine learning or AI models without our prior written consent; or (e) use the Service in violation of law or third-party rights.
You retain ownership of information and content you submit (“User Content”). You grant us a license to host, process, transmit, display, and back up User Content as needed to operate and improve the Service, consistent with our Privacy Policy. You represent you have the rights needed to grant this license.
The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation.
To the fullest extent permitted by law, Simon J Williams will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from your use of the Service.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles, subject to applicable federal law.
If you provide a mobile number or are added to an incident SMS roster, you agree to receive transactional text messages from Comm-Piler about that incident or equipment loan (helpdesk alerts, return reminders, or coordinator review notices — not marketing). Message frequency varies by incident activity. Message and data rates may apply. Reply STOP to cancel SMS from our program; reply HELP for help.
